All goods remain the property of Modern Tiles Macarthur until payment has been received in full.
An order is not considered reserved or secured until full payment has been received.
Customers should carefully check product descriptions, quantities, sizes, colours and other details before confirming an order.
Prices, stock levels and availability may change without notice. While we make reasonable efforts to keep information accurate, errors may occasionally occur.
Tiles, Stone & Product Variation
Tiles, mosaics and natural stone can vary in colour, shade, texture, pattern, calibre and appearance.
Natural stone is a natural product and variations, including differences in colour, veining, texture and markings, form part of its natural character.
Customers should inspect products before installation and, where appropriate, mix tiles from several boxes to achieve a balanced appearance.
Installation of a product may be regarded as acceptance of its appearance, subject always to any rights the customer has under Australian Consumer Law.
Quantities & Measurements
Customers are responsible for confirming the quantities required for their project.
We recommend allowing appropriate additional material for cuts, breakages, wastage and future repairs.
Any quantity calculations or estimates provided by our staff are provided as assistance only and should be checked against the measurements and requirements of the project before ordering.
Product Suitability & Installation
Customers, builders and installers are responsible for confirming that products are suitable for their intended application and are installed in accordance with applicable standards, manufacturer instructions and good trade practice.
Where there is uncertainty regarding substrate preparation, waterproofing, adhesives, sealers, installation or other technical requirements, advice should be obtained from an appropriately qualified tradesperson or the relevant product manufacturer.
Modern Tiles Macarthur does not automatically provide refunds or exchanges for change of mind, over-ordering, incorrect measurements or incorrect product selection.
In some circumstances, Modern Tiles Macarthur may agree to accept a return at its discretion.
50% Restocking Fee
Where a discretionary return is accepted, a 50% restocking fee applies.
Returned goods must be in their original condition, unopened, undamaged and suitable for resale.
Acceptance of any discretionary return remains subject to approval by Modern Tiles Macarthur.
We strongly recommend keeping a few spare boxes of tiles after your project is completed for future repairs, alterations or accidental damage.
Tiles are manufactured in batches, and the same colour, shade, calibre or design may not be available again in the future.
For this reason, we generally cannot accept the return of a small number of leftover boxes. Once only a few boxes remain from a batch, they can be extremely difficult for us to resell as a useful quantity for another customer’s project.
Keeping your spare tiles also gives you the best chance of having an exact batch match if a tile ever needs replacing.
Australian Consumer Law
The above change-of-mind and restocking conditions do not apply where a customer is entitled to a remedy under the Australian Consumer Law.
Nothing in this returns policy excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded.
If you believe goods are faulty, damaged or different from what was ordered, please contact Modern Tiles Macarthur as soon as reasonably possible and provide proof of purchase.
We may need to inspect the goods or obtain photographs or other information to assess the issue.
Check Before Installation
Please check tiles and other products before installation.
If you believe there is a problem with the product, stop installation and contact us before proceeding wherever reasonably possible.
Claims concerning visible differences or issues are considerably easier to assess before the product has been installed.
Where goods fail to satisfy a consumer guarantee under the Australian Consumer Law, customers may be entitled to a repair, replacement, refund or other remedy depending on the circumstances and whether the failure is major or minor.
Nothing in this policy limits rights that cannot legally be excluded under the Australian Consumer Law.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
Nothing in these Terms & Conditions, Returns Policy or Privacy Policy is intended to exclude, restrict or modify any statutory right or remedy that cannot lawfully be excluded.
Customers collecting goods are responsible for ensuring that their vehicle is suitable for the size and weight of the products being collected and that the load can be transported safely.
Where delivery is arranged, estimated delivery dates and times are provided in good faith but may be affected by circumstances outside our control.
Customers must provide suitable and safe access for delivery and ensure that an authorised person is available where required.
Third-party delivery services may be used.
